These Terms govern your use of the Service, effective from the time SwimSchoolPro grants you access. By registering, you confirm that you have read and understood these Terms and have the authority to act on behalf of any entity you represent.

  • Service: Online management tools provided via the SwimSchoolPro website.
  • Website: Swimschoolpro.com or other sites operated by SwimschoolPro.
  • SwimschoolPro: SwimschoolPro LLC and its affiliates.
  • Subscriber: The person or entity registering for the Service.
  • You: The Subscriber and, where relevant, any authorized Invited User.

1. Use of Software

SwimschoolPro grants you a limited, non-transferable right to use the Service in line with these Terms, based on your subscription. Subscribers control access for Invited Users, including roles, permissions, and any adjustments.

2. Your Obligations

  • Payment: Invoices are issued monthly. Payments are due within seven days. Unpaid fees may result in suspension.
  • Discounts: Preferential rates depend on the number of organizations added and payment responsibility for each.
  • General Use: You agree to use the Service for lawful purposes only and ensure compliance by all authorized users.
  • Access Security: Keep passwords confidential. Notify SwimschoolPro of any breaches.
  • Limitations: Usage may be subject to limits, such as transaction volumes.
  • Communication: Communication tools on the website should be used responsibly.

3. Confidentiality and Privacy

  • Confidentiality: Both parties agree to protect each other’s Confidential Information. Obligations survive termination of these Terms.
  • Privacy: The privacy policy governs the handling of personal data, and by accepting these Terms, you agree to this policy.

4. Intellectual Property

  • Ownership: SwimschoolPro retains rights to the Service and Website. Data ownership remains with you, contingent on fee payment.
  • Data Backup: Regular backups are performed, but SwimschoolPro doesn’t guarantee against data loss.
  • Third-party Applications: Enabling third-party apps may grant them access to your Data.

5. Warranties and Acknowledgments

  • Authority: You confirm that you have the authority to accept these Terms on behalf of others.
  • Acknowledgment: You assume responsibility for the suitability of the Service for your needs and compliance with relevant laws.
  • No Warranties: SwimschoolPro doesn’t guarantee uninterrupted Service and excludes implied warranties, where permitted by law.

6. Limitation of Liability

To the extent allowed by law, SwimschoolPro is not liable for losses from use of the Service. If negligence by SwimschoolPro leads to losses, liability is limited to three months’ worth of Access Fees.

7. Termination

  • Trial Policy: Users may evaluate the Service under trial conditions without obligation.
  • Prepaid Subscriptions: No refunds for prepaid subscriptions.
  • Termination for Breach: Breaches not remedied within 14 days may result in suspension or termination.
  • Accrued Rights: Termination doesn’t affect prior obligations. Upon termination, all use of the Service must stop.

For technical issues, please check online resources or contact support at info@swimschoolpro.com. SwimschoolPro strives for continuous availability but may schedule maintenance.

9. General

  • Entire Agreement: These Terms and any related policies form the complete agreement.
  • Waiver: Waivers must be in writing and do not apply to future breaches.
  • Jurisdiction: This Agreement is governed by Australian law.
  • Severability: If any part of these Terms is invalid, remaining provisions still apply.
  • Notices: Communications should be via email. Notices from SwimschoolPro will go to the email you provided.
